Smoke-Free Parks Except in Designated Areas

Whereas,                             The Buffalo Common Council, as the legislative body for The City of Buffalo, enacts ordinances on behalf of the residents of The City of Buffalo;


Whereas,                             in the interest of public safety, The City of Buffalo Common Council’s major concerns are the health and welfare of our citizens;


Whereas,                             smoking kills 28,200 New York adults each year;


Whereas,                             in 2016, there will be an estimated 1,685,210 new cancer cases diagnosed and 595,690 cancer deaths in the US; and


Whereas,                            in recent meetings with Roswell Park Cancer Institute, they have expressed their desire to place no smoking (except for designated areas) signs in public parks due to the discovery that The City of Buffalo currently has no ordinance against smoking tobacco or electronic cigarettes, in City parks: Now, Therefore Be It


Resolved that The City of Buffalo Common Council


1)              Directs the Law Department to include City parks in the current smoking ordinance §399.


2)              Forward copies of this resolution to the following: Mayor Byron Brown, Commissioner Daniel Derenda, Corporation Counsel Timothy Ball, Chief Carmen Menza, Erie County Executive Mark Poloncarz, The Roswell Park Cancer Institute, and Deputy Chief Beaty.
